Booking Terms

Terms for the direct online booking of date-specific diving courses and training sessions with DivemetoHeaven.

Last updated: 24 July 2026. These terms apply only to directly booked courses and training sessions, not to travel referrals.

Directly bookable offers

  • Only courses and training sessions can be booked directly through the DivemetoHeaven online checkout.
  • Travel remains inquiry-based and is not sold through online checkout.
  • If you request a travel referral after consultation, the travel contract is concluded exclusively with the referring travel agency or tour operator. We will identify the specific contracting party before transmitting your data. That provider's separate contractual terms apply to the travel contract.

Offer and contract formation

  • The product, session, essential service characteristics, participant count, unit price, total price and payment method are summarized in checkout immediately before the booking is submitted.
  • By clicking 'Book with payment obligation', you submit a binding offer for the selected course or training session. You are then redirected to the selected payment method.
  • The contract is concluded only when the payment provider has successfully confirmed payment and DivemetoHeaven has electronically confirmed the booking. An abandoned or failed checkout does not result in a contract.

Prices and payment

  • All total prices displayed in checkout are gross prices and include statutory VAT. Additional costs are charged only if they are expressly shown in the specific offer before booking.
  • The total price is due immediately upon conclusion of the contract and is processed through Stripe or PayPal as selected in checkout. Card and account credentials are not stored by DivemetoHeaven.
  • If an SSI kit is part of the offer, its price component is shown before booking. Once the digital kit has been activated, that price component is non-refundable and access remains with the participant.

Participation and SSI certification

  • The customer must meet the age, qualification, health and equipment requirements stated in the specific offer and provide complete and accurate information. Minors require the necessary declarations from their legal guardians.
  • The Training Record, medical self-declaration and Responsible Diver Code must be completed by hand as required for the course and brought to the session. Medical clearance may be required where there are safety-related concerns.
  • Payment and attendance alone do not guarantee SSI certification. Certification requires full participation, achievement of the required knowledge and skills and compliance with the applicable SSI standards.

Right of withdrawal

  • The directly bookable courses and training sessions are services related to leisure activities and are booked for a specific date or period. Under section 312g(2) no. 9 of the German Civil Code, there is no statutory right of withdrawal for these contracts.
  • The cancellation and rebooking options below are granted voluntarily and independently of any statutory right of withdrawal.

Cancellation by the customer

  • Cancellation must be declared in text form by email to [email protected]. The time the email is received is decisive.
  • If cancellation is received no later than 14 calendar days before the start, the cancellation charge is 10 percent of the applicable course or training price. For a booking covering several people, only the price attributable to the cancelling participant is taken into account.
  • If cancellation is received 13 to 7 calendar days before the start, the cancellation charge is 50 percent. For a later cancellation or non-attendance, the charge is 80 percent of the applicable course or training price.
  • If a participant is temporarily or permanently unable to dive because of a medical condition, we refund at least 50 percent of that participant's course or training price. If the general cancellation rule is more favourable to the participant, that rule applies. A medical certificate confirming temporary or permanent unfitness to dive is required; no diagnosis is necessary. Alternatively, at its discretion and subject to available capacity, DivemetoHeaven may offer a one-time rebooking to another session. There is no entitlement to rebooking or to a specific replacement session. Without a medical certificate, the general cancellation rules above apply.
  • An activated SSI kit is non-refundable even in the event of medically justified cancellation because access remains with the participant. Any refund and administration fee are therefore calculated only from the remaining course or training price.
  • You may demonstrate that DivemetoHeaven incurred no loss or a substantially lower loss as a result of the cancellation. In that case, the retained cancellation charge is reduced accordingly.
  • Where third-party services have already been commissioned for the booked activity, third-party costs actually incurred and not recoverable are not refunded if the customer is responsible for the activity not taking place. Statutory refund and damages claims, particularly where DivemetoHeaven is responsible for non-performance, remain unaffected.
  • Transfer of the booking to a substitute participant is excluded.

Rebooking

  • One rebooking to an available course or training session is free of charge if requested at least 14 calendar days before the start. There is no entitlement to a particular replacement date.
  • Later rebooking requests are treated as cancellation of the existing booking and a new booking. An activated SSI kit remains assigned to the participant and is not charged again where it can continue to be used for the replacement session.

Cancellation and changes by DivemetoHeaven

  • Where the offer states a minimum participant count and it is not reached, DivemetoHeaven may cancel the session no later than seven calendar days before the start. The customer may choose between an offered replacement session and reimbursement of amounts paid for services not yet provided.
  • In the event of instructor illness, unsuitable weather, water or safety conditions or other circumstances that cannot reasonably be controlled, the schedule may be adjusted or a replacement session offered. Safety takes priority over delivery as originally scheduled.
  • If no reasonable replacement session can be offered or you do not accept the replacement offered, we refund the amounts paid for services not provided. An activated SSI kit remains usable and is non-refundable.

Safety and exclusion from participation

  • Participants must follow safety instructions and must not participate under the influence of alcohol, drugs or substances that impair diving safety. Participation may be interrupted or ended where there is a specific safety risk.
  • Where exclusion results from a serious breach attributable to the participant or inaccurate information concerning mandatory requirements, any reimbursement is governed by statutory law and the expenses actually saved.

Liability

  • DivemetoHeaven has unlimited liability for intent and gross negligence and for injury to life, body or health. Liability under mandatory statutory provisions remains unaffected.
  • In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the typical foreseeable loss. Otherwise, liability for slight negligence is excluded to the extent permitted by law.

Contract language and applicable law

  • The contract is concluded in the language selected in checkout. German law applies while preserving mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
  • Statutory provisions apply to jurisdiction and out-of-court remedies.
